Sweepstakes Official Rules and Regulations (the "Official Rules") (collectively "Agreement")
NO PURCHASE IS REQUIRED TO ENTER. VOID WHERE PROHIBITED - SWEEPSTAKES IS OFFERED ONLY TO CURRENT LEGAL RESIDENTS OF THE FIFTY (50) CONTINGUOUS STATES OF THE UNITED STATES (U.S.) (EXCLUDING RHODE ISLAND) WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AT TIME OF ENTRY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCE OF WINNING.
Eligibility
Entries for Perfectmatch.com/MarketRange, Inc. ("Sponsor") - "Dating Brad Garrett Sweepstakes" ("Sweepstakes") will be accepted beginning September 22, 2008 at 12.01 a.m. PDT and ending November 30, 2008 at midnight PST ("Sweepstakes Period"). Entry is available via the World Wide Web at Perfectmatch.com. Those who enter (collectively "Entrant" or "Entrants") must provide their first (1st) name, last name, street address (no P.O. Boxes), city, state, zip code, daytime telephone number (including area code), date of birth, email address, gender, marital status (optional) and the correct answer to the stated weekly trivia question to successfully enter the Sweepstakes. To be eligible to win, Entrants must go online and enter at www.perfectmatch.com, which includes answering the weekly trivia question by selecting one (1) of three (3) provided answers. If the Entrant incorrectly answers the weekly trivia question, they have the opportunity to answer it again until answering correctly. A correctly answered trivia question allows the Entrant one (1) entry into the Sweepstakes after successful submission of Entrant's entry form as described above. Entrants are limited to one (1) entry per person/email address per week. All weekly entries will rollover to the grand prize ("GP") entry.
Weekly Schedule
The weekly schedule for the trivia question for ten (10) weeks will be as follows: Entrants who successfully enter between 12.01 a.m. PDT on September 22, 2008 and 11.59 p.m. PDT September 28, 2008 will be eligible for the first (1st) weekly prize ("WP"); Entrants who successfully enter between 12.01 a.m. PDT on September 29, 2008 and 11.59 p.m. PDT October 5, 2008 will be eligible for the second (2nd) WP; Entrants who successfully enter between 12.01 a.m. PDT on October 6, 2008 and 11.59 p.m. PDT on October 12, 2008 will be eligible for the third (3rd) WP; Entrants who successfully enter between 12.01 a.m. PDT on October 13, 2008 and 11.59 p.m. PDT October 19, 2008 will be eligible for the fourth (4th) WP; Entrants who successfully enter between 12.01 a.m. PDT on October 20, 2008 and 11.59 p.m. PDT October 26, 2008 will be eligible for the fifth (5th) WP; Entrants who successfully enter between 12.01 a.m. PDT on October 27, 2008 and 11.59 p.m. PDT November 2, 2008 will be eligible for the sixth (6th) weekly prize; Entrants who successfully enter between 12.01 a.m. PDT on November 3, 2008 and 11.59 p.m. PDT November 9, 2008 will be eligible for the seventh (7th) WP; Entrants who successfully enter between 12.01 a.m. PST on November 10, 2008 and 11.59 p.m. PST November 16, 2008 will be eligible for the eighth (8th) WP; Entrants who successfully enter between 12.01 a.m. PST on November 17, 2008 and 11.59 p.m. PST November 23, 2008 will be eligible for the ninth (9th) WP; and Entrants who successfully enter between 12.01 a.m. PST on November 24, 2008 and 11.59 p.m. PST November 30, 2008 will be eligible for the tenth (10th) WP.
By entering this Sweepstakes, Entrants give their express permission to be contacted by Sponsor by telephone, email and/or postal mail for Sweepstakes purposes only. Additionally, if an Entrant chooses to opt-in to a specific offer from a participating Sweepstakes Entity (as defined below), her/his personal information will be subject to that Sweepstakes Entity's privacy policy and terms of service (if applicable), and such Entrant agrees to receive additional email communication from that Sweepstakes Entity. Respective privacy policies of Sweepstakes Entities participating in opt-ins will be accessible from Sweepstakes entry page. Sponsor and Sweepstakes Entities are not responsible for lost, incomplete, illegible, late, misdirected, stolen, or mutilated entries, account information, mail or email or postage-due mail; failures or malfunctions of phones, phone lines or telephone systems; lost entries or transmissions; any error, omission, interruption, defect or delay in transmission, transaction processing, or communication; interrupted or unavailable network, server or other connections; miscommunications, failed computer hardware or software or technical failures; garbled, misrouted or scrambled transmissions; printing errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, telephone, electronic, mail or otherwise. Sponsor reserves the right, in its sole discretion, to void any and all entries of an Entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes. The use of automated entry or similar devices is prohibited and entries through such devices are void. The authorized account holder ("AAH") of the email address submitted at the time of entry is defined as the natural person who is assigned to the email address by an Internet access provider, online service provider or other organization (i.e., business, educational institution, etc.) which is responsible for assigning email addresses for the domain associated with the submitted email address. Proof (to Sponsor's satisfaction) of being the AAH may be required by Sponsor.
Notification
Following the Sweepstakes Period, on or about December 15, 2008, winners will be selected by random drawing from the pool of eligible Entrants. If a potential winner can't be reached at the email address or telephone number provided on the entry form within five (5) business days from Sponsor's first (1st) attempt to contact her/him, or if she/he is found to be ineligible, or if she/he can't or doesn't otherwise comply with these Official Rules, an alternate winner will be selected by random drawing. Odds of winning a prize depend on the number of eligible entries received.
Prizes
One (1) Grand Prize Winner ("GPW") will receive: One (1) roundtrip, coach-class air transportation for GPW and one (1) guest from a major airport near GPW's home (determined by Sponsor in its sole discretion) to San Jose, CA (approximate retail value ["ARV"] One Thousand and No/100ths Dollars [$1,000.00]; roundtrip ground transportation from San Jose International Airport to the Hotel Los Gatos (ARV One Hundred Forty and No/100ths Dollars [$140.00]; two (2) hotel accommodations in a one (1) bedroom suite (double occupancy), room and tax only stay at the Hotel Los Gatos (ARV Seven Hundred Thirty-Eight and No/100ths Dollars [$738.00]; spa treatments for two (2) at Spa Elia including the Mediterranean Inspired Warm Poultice Massage, VinoTherapy Facial Treatment and Signature Mediterranean Pedicure (ARV Six Hundred Eighty and No/100ths Dollars [$680.00]; spa gift basket (ARV Two Hundred Forty-Two and No/100ths Dollars [$242.00]; one (1) e-gift certificate ("e-GC") redeemable at Makeup.com [ARV Two Hundred Fifty and No/100ths Dollars [$250.00]; and one (1) Guy and Eva e-GC (ARV Two Hundred and No/100ths Dollars [$200.00]. The ARV of the GP is Three Thousand Two Hundred Fifty and No/100ths Dollars ($3,250.00). Ten (10) Weekly Winners ("WW") will receive a WP of: One (1) e-GC redeemable at Makeup.com (ARV One Hundred and No/100ths Dollars [$100.00]; and one (1) Guy and Eva e-GC (ARV Fifty and No/100ths Dollars [$50.00]. Total ARV of the WW WP is One Thousand Five Hundred and No/100ths Dollars ($1,500.00). Total ARV of all prizes is Four Thousand Seven Hundred Fifty and No/100ths Dollars ($4,750.00).
Guest of GPW must be at least eighteen (18) years of age at time of GP fulfillment. If eighteen (18) isn't the age of majority in the jurisdiction in which GPW and/or guest resides, GPW and/or guest, as applicable, must be accompanied by her/his parent/legal guardian, and such person must pay her/his own expenses (unless the minor GPW brings her/his parent/legal guardian as a guest).
Employees, agents, successors and assignees of the Sponsor, its advertising agencies and associated companies involved in the Sweepstakes, and employees of SONY PICTURES TELEVISION INC., Spa-Addicts.com, Makeup.com Limited, Guy and Eva Inc. and any subsidiaries and/or affiliate entities thereof, as well as family and household members (spouses, children, siblings, parents) and other persons living in the same household as such persons, whether or not related, of each of the foregoing ("Sweepstakes Entities"), shall be ineligible to participate.
ANY PRIZE IS AWARDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
Entrants waive the right to claim as a cost of winning any prize, any and all costs or expenses associated with redemption or travel to redeem.
By accepting any prize, the GPW agrees to and releases Sponsor, SONY PICTURES TELEVISION INC., the prize sponsors and their respective employees and agencies, representatives, affiliates and subsidiaries, advertising and promotions agents from all liability of any type whatsoever.
Prize Restrictions
The prize must be taken, and travel must be completed by November 30, 2009 Travel subject to all applicable travel restrictions as outlined in the prize winner notification letter, availability of lodging at time of booking, blackout dates, fare restrictions, availability of services offered and other criteria. All expenses not expressly stated in the package description, including but not limited to insurance, gratuities, meals, ground transportation, passport and visa fees, security fees, taxes, insurance, gasoline or otherwise are the responsibility solely of the GPW. Travel restrictions, conditions and limitations may apply. Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates. No cash or other substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize or prize component with another of comparable or greater value. If the prize is not claimed within the specified time limit, the prize will be forfeited. Federal taxes, local state taxes, and any other fees or costs connected with the prize will be the sole responsibility of the GPW. The GPW must give a minimum of twenty-one (21) days advance notice of desired travel. The GPW and guest must travel together on the same itinerary including the same departure date, destination and return date. Sponsors are not liable for expenses incurred due to flight cancellations or flight delays.
All winners will be notified by telephone or email within five (5) business days after the date on which such winner is selected by Sponsor. The GPW must respond within forty-eight (48) hours of notification or risk forfeiture of the prize at the Sponsor's discretion. The Sponsor is not liable for any notification delay.
The Sponsor will have the power to rule on all aspects of the Sweepstakes. The decisions of the Sponsor shall be final and irreversible. The Sponsor reserves the right to make any necessary or appropriate changes to the Sweepstakes as it progresses. The Sponsor reserves the right to cancel or modify the Sweepstakes in whole, or in part, in event of technical or other difficulties or for any other reason at any time in its sole discretion.
Agreement to Terms
The Sweepstakes is subject to this Agreement and all applicable federal, state, and local laws and regulations. By participating in this Sweepstakes, Entrant acknowledges Entrant has read this Agreement and agrees to abide by its terms and by the decisions of the Sponsor, which are final and binding on all matters pertaining to the Sweepstakes. All U.S. federal, state, and local laws and regulations apply. This drawing is void where prohibited or restricted by law. Residents of the State of Rhode Island are ineligible to participate in this Sweepstakes. Prize winners will be responsible for all applicable taxes. The Sponsor reserves the right to change these Official Rules at any time and for any reason whatsoever, with no notice required, in its sole discretion.
NEITHER SPONSOR, ITS SUBSIDIARIES BOTH DIRECT OR INDIRECT, OFFICERS, DIRECTORS, CONTRACTORS, OR ANY OF ITS AGENTS OR AFFILIATES OR ASSIGNS, SONY PICTURES, AND ANY SUBSIDIARIES AND/OR AFFILIATE ENTITIES THEREOF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS ("RELEASEES") SHALL BE RESPONSIBLE FOR AND ENTRANTS BY ENTERING HEREBY RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS RELEASEES FROM AND AGAINST ANY CLAIMS, COSTS, LIABILITY OR DAMAGES WHATSOEVER DUE TO ANY INJURIES, DAMAGES LOSSES TO ANY PERSON (INCLUDING DEATH) OR PROPERTY OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY FROM PARTICIPATING IN THE SWEEPSTAKES, SUBMITTING AN ENTRY, WINNING ANY PRIZE, ACCEPTANCE, POSSESION, MISUSE OR USE OF ANY PRIZE, OR PARTICIPATION IN ANY SWEEPSTAKES- RELATED ACTIVITY OR ANY DAMAGES WHATSOEVER OTHERWISE ARISING OUT OF THIS SWEEPSTAKES.

By entering this Sweepstakes, the Entrant agrees that any and all claims against Sponsor, its affiliates, employees, officers, directors, judges and agents arising out of this drawing shall be settled by final and binding arbitration before the American Arbitration Association pursuant to the U.S. Arbitration Act, 9 U.S.C. §1-16, or before the American Arbitration Association under its International Arbitration Rules if the claim arises from conduct outside of the U.S. Any such claim must be filed with the American Arbitration Association by January 31, 2009, or no claim or action may be sustained against MarketRange, Inc., its affiliates, employees, officers, directors, judges and agents arising out of this Sweepstakes.
By entering a drawing in this Sweepstakes, each Entrant agrees to be bound by each and every term of these Official Rules.
